These Terms outline the professional planning and consulting services provided by Jess Peterman LLC dba Jess Peterman Travel (“we” or “I”), performed in my role as an Independent Contractor affiliated with Key to the World Travel, LLC (“KTTWT”). All travel reservations are processed exclusively through KTTWT under its Seller of Travel credentials. 1. Scope of Services

Advisor provides professional travel planning and consulting services. Advisor is an independent contractor affiliated with KTTWT. All travel reservations are processed through KTTWT under its applicable licensing and Seller of Travel credentials. Advisor does not independently hold Seller of Travel registration and does not process supplier payments directly.

Advisor acts solely as an agent for disclosed third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, tour operators, transportation providers, and destination management companies. Advisor does not own, operate, manage, or control any supplier and is not responsible for supplier acts, omissions, errors, insolvency, delays, cancellations, or service failures. Nothing in this relationship creates a fiduciary duty between Advisor and Client.

Advisor provides itinerary design, travel planning, supplier coordination, and reservation facilitation based on information provided by Client. Advisor does not guarantee pricing, availability, schedules, amenities, supplier performance, travel outcomes, or satisfaction with any supplier. Pricing and availability are dynamic and subject to change until confirmed and ticketed by the supplier. Advisor does not provide legal, medical, financial, immigration, or real-time travel monitoring services unless expressly agreed in writing.


2. Planning & Concierge Fees

Professional planning services are compensated through a non-refundable retainer beginning at $125 per person for trips up to two weeks. The final amount is determined based on trip complexity, duration, number of travelers, and service level. The retainer is earned upon receipt, is non-refundable, is compensation for time, expertise, research, and itinerary design, is not held in trust, and is not contingent upon booking. Additional service fees may apply for significant revisions, last-minute planning, reinstatement of canceled files, group coordination, or post-booking changes.


3. Relationship with Key to the World Travel

Key to the World Travel LLC is the travel agency responsible for processing reservations and serving as the agency of record. Advisor works under KTTWT’s licensing and credentials, and all bookings are subject to KTTWT’s Terms of Service and Privacy Policy and the terms and conditions of each travel supplier involved in the itinerary. Advisor does not independently hold Seller of Travel registration and does not process supplier payments.


4. Role of the Travel Advisor

In arranging travel, Advisor acts as an agent for the travel suppliers providing travel services. Advisor does not own, operate, or control any supplier. Decisions regarding schedules, delays, cancellations, substitutions, service delivery, and refunds are made by suppliers. Advisor may assist with communications and advocacy, but responsibility for performance and remedies lies with the supplier and is governed by supplier terms.


5. Client Responsibilities

Client agrees to provide complete and accurate information, including traveler names exactly as shown on government-issued identification, dates of birth, contact information, and any special requirements. Client is responsible for obtaining and understanding passport, visa, vaccination, health, and destination entry requirements for all destinations and transit points. Upon receipt of confirmations and travel documents, Client must review them promptly and notify Advisor within twenty-four (24) hours of any errors. Client understands that failure to review and notify may result in additional costs, supplier penalties, or inability to correct items later.


6. Payments for Travel

Payments for travel services are made directly to suppliers or processed through KTTWT’s secure systems. Client authorizes transmission of payment information for approved bookings. Client agrees not to initiate a credit card chargeback for any transaction that was authorized and processed in accordance with supplier and agency terms. An improper chargeback includes any dispute initiated despite Client’s prior written authorization and acceptance of applicable cancellation and refund policies. If an improper chargeback occurs, Client agrees to reimburse Advisor and/or KTTWT for related fees, penalties, administrative costs, arbitration costs, collection expenses, and reasonable attorney’s fees incurred in resolving the dispute. Client must submit any payment dispute in writing and provide a reasonable opportunity to resolve the issue before initiating external action.


7. Changes and Cancellations

All bookings are subject to supplier change and cancellation policies. Supplier rules govern penalties, credits, and refund timelines. Advisor’s professional fees remain non-refundable regardless of cancellation reason, supplier refund outcome, force majeure event, illness, travel disruption, dissatisfaction, or schedule changes. Client acknowledges that cancellation penalties may begin immediately after deposit.


8. Travel Insurance

Travel protection insurance is strongly recommended. Client understands that declining coverage shifts financial risk to Client. If Client declines coverage, Client assumes financial responsibility for losses arising from cancellation, interruption, illness, injury, delay, supplier insolvency, or force majeure events.


9. Liability Limitations

Advisor is not liable for injury, loss, damage, delay, inconvenience, or irregularity arising from supplier acts or omissions or events beyond Advisor’s control, including schedule changes, cancellations, weather events, labor disputes, government actions, epidemics, and force majeure events.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVISOR’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF PROFESSIONAL PLANNING FEES PAID BY CLIENT.

ADVISOR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EMOTIONAL DISTRESS, LOSS OF ENJOYMENT, OR PUNITIVE DAMAGES.


10. Use of Personal Data

Personal information provided by Client is used to create, manage, and secure travel arrangements. Client authorizes sharing of information with KTTWT and travel suppliers as needed to complete bookings and provide services. Client data is handled in accordance with KTTWT’s privacy policy and applicable regulations.


11. Governing Law

These Terms are governed by the laws of the State of Washington.


12. Dispute Resolution

Any dispute arising out of or relating to professional planning services provided by Jess Peterman LLC shall be resolved exclusively through binding arbitration conducted in Spokane County, Washington, in accordance with the rules of the American Arbitration Association. Each party shall bear its own attorney’s fees unless otherwise awarded by the arbitrator. Any claim must be brought within twelve (12) months of the completion of travel or the cancellation date, whichever occurs first.

Client waives any right to trial by jury and agrees that claims shall be brought only in an individual capacity and not as a class, collective, or representative action.

This arbitration provision applies only to professional planning services provided by Jess Peterman LLC and does not alter or replace KTTWT’s dispute resolution provisions.


13. No Guarantee of Outcomes

Recommendations and travel advice are based on professional judgment and information available at the time. Advisor does not guarantee supplier performance, availability, pricing stability, weather, travel requirements, safety conditions, or satisfaction with third-party services. Decisions made by Client based on information provided remain Client’s responsibility.


14. Assumption of Risk

Client acknowledges that travel involves inherent risks including illness, injury, crime, political instability, transportation delays, mechanical failures, weather events, supplier bankruptcy, governmental actions, and civil unrest. Client voluntarily assumes all risks associated with travel and participation in activities or excursions. Participation in hosted events and activities is voluntary. If participating in hosted or group trips involving alcohol, Client acknowledges that alcohol consumption is voluntary and undertaken at Client’s own risk. Advisor does not serve or supervise alcohol and is not responsible for consequences arising from alcohol use. Advisor reserves the right to remove a participant from a group trip for disruptive, unsafe, or inappropriate conduct. Removal may occur without refund.


15. Third-Party Excursions

Excursions or activities not operated directly by a primary supplier are independent services. Participation may involve physical exertion and risk of injury or death. Advisor does not control provider operations, staffing, equipment, vehicles, or safety protocols. Client assumes all associated risks.


16. Group Travel Terms

Group pricing, amenities, private events, and inclusions are contingent upon supplier contracts and minimum participation requirements. If minimum thresholds are not met, suppliers may modify pricing or benefits. Advisor is not responsible for disputes between participants, roommate conflicts, or participant-to-participant claims. Advisor shall have sole discretion in determining whether removal is necessary.


17. Indemnification

Client agrees to indemnify, defend, and hold harmless Jess Peterman LLC and Key to the World Travel LLC from and against any and all claims, liabilities, losses, damages, demands, actions, arbitration costs, and reasonable attorney’s fees arising out of or relating to Client’s misconduct, failure to obtain proper documentation, health issues, violation of supplier rules, participation in travel, activities, excursions, or group events, claims brought by other participants, or any third-party claim arising from Client’s actions or omissions.


18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.


19. Force Majeure

Advisor shall not be liable for any failure, delay, disruption, cancellation, refund limitation, credit issuance, supplier refusal to refund, or modification of travel services arising from events beyond Advisor’s control. Such events include but are not limited to acts of God, pandemics, epidemics, public health emergencies, government travel restrictions, border closures, supplier insolvency, labor strikes, weather events, civil unrest, terrorism, mechanical failures, or other force majeure events.

Client acknowledges that in force majeure situations, suppliers may offer credits instead of refunds or may deny refunds entirely pursuant to their policies. Advisor has no authority to override supplier policies and makes no guarantee of refund outcomes.

Professional planning fees remain earned and non-refundable regardless of force majeure circumstances.


20. Acknowledgment

These Terms govern professional planning services provided by Jess Peterman LLC and operate in conjunction with KTTWT’s Terms of Service and Privacy Policy, which govern booking services. These Terms supersede all prior discussions, representations, marketing statements, promotional materials, proposals, or agreements, whether oral or written, relating to Advisor’s professional planning services. Client acknowledges that no reliance has been placed on any statement not expressly set forth in these Terms.


21. Electronic Acceptance and Acknowledgment

By approving a proposal, signing an invoice, checking a required acceptance box, or authorizing payment, Client confirms that Client has read and agrees to these Terms and is authorized to accept on behalf of all travelers in the party. Client further acknowledges that such approval constitutes legally binding electronic acceptance under applicable electronic transaction laws.
