These Terms outline the professional planning and consulting services provided by Jess Peterman LLC dba Luxury Travel by Jess (“we” or “I”), performed in my role as an Independent Contractor affiliated with Key to the World Travel, LLC (“KTTWT”). All travel reservations are booked exclusively through KTTWT under its Seller of Travel credentials. 1. Scope of Services
Jess Peterman LLC dba Luxury Travel by Jess provides professional travel planning, consultation, research, and itinerary design. These services support the booking process conducted through KTTWT. While I design, coordinate, and manage the planning process, all reservations, payments, and supplier transactions are processed under KTTWT’s credentials as the agency of record.
2. Planning & Concierge Fees
My planning, research, and concierge services are compensated through a non-refundable fee paid to Key to the World Travel on my behalf. This fee reflects the time, expertise, consultation, and itinerary design provided throughout the planning process. The fee amount is disclosed before any work begins. Once paid, the fee is earned in full and will not be refunded, even if travel plans change or no booking is completed. This fee is separate from deposits or payments required by travel suppliers.
3. Relationship with Key to the World Travel
Key to the World Travel is the travel agency responsible for processing your reservations. I work under KTTWT’s licensing and credentials, and all bookings are subject to KTTWT’s Terms & Conditions as well as the terms of each travel supplier involved in your itinerary. Jess Peterman LLC does not hold seller-of-travel registrations and does not process supplier payments.
4. Role of the Travel Advisor
In arranging travel, I act as an advisor and agent for the travel suppliers providing your services. These suppliers include airlines, cruise lines, hotels, tour operators and transportation companies. I do not own, operate, or control any supplier. Decisions regarding schedule changes, delays, cancellations, or service delivery are made solely by the suppliers. I will advocate for you in the event of an issue, but responsibility for performance and remedies lies with the individual supplier.
5. Client Responsibilities
You agree to provide complete and accurate information including traveler names as listed on passports, dates of birth, contact details, and any special requirements. You are responsible for understanding and complying with passport, visa, vaccination and destination entry requirements. Upon receiving booking confirmations or travel documents, you must review them promptly and notify me within 24 hours of any errors. Failure to do so may result in additional costs or an inability to make corrections later.
6. Payments for Travel
Payments for travel services are made directly to the supplier or through KTTWT’s secure payment system. I do not accept checks or credit card payments directly. You will be asked to complete a secure payment authorization that permits KTTWT to process charges to the supplier for your booking. Authorization must be provided for each charge. For security purposes, I do not accept payment information by email, text message or voicemail.
7. Changes and Cancellations
Change and cancellation requests must be submitted in writing. All bookings are governed by the supplier’s terms which may include penalties, non-refundable components or limited refund windows. My planning fee remains non-refundable in the event of cancellation. If KTTWT or the supplier charges administrative fees related to your change or cancellation request, those will be your responsibility.
8. Chargebacks
By providing a credit card for use in supplier payments, you agree not to initiate a chargeback for charges made according to supplier terms. If there is a dispute regarding refunds or penalties, I will assist in communicating with the supplier, but supplier policies ultimately apply. Improper chargebacks may result in recovery of fees or expenses incurred by KTTWT on your behalf.
9. Travel Insurance
Comprehensive travel insurance is strongly recommended. Insurance can help protect against cancellation, delay, interruption, medical emergencies, evacuation, supplier failure, lost luggage and other unexpected events. If you decline coverage, you assume all financial risk for events that insurance would have covered. I can assist by providing plan options; all claims decisions are made by the insurance provider.
10. Liability Limitations
Jess Peterman LLC and Key to the World Travel are not liable for injury, loss, damage, delay, inconvenience or irregularity that may arise from the acts or omissions of suppliers or any event beyond our control. This includes schedule changes, cancellations, weather events, labor disputes, government actions, epidemics, and force majeure events. My liability is limited to the amount of the planning fee paid to KTTWT on my behalf. KTTWT’s liability is limited to the commissions and fees earned for the booking.
11. Use of Personal Data
Personal information you provide will be used to create, manage and secure your travel arrangements. Information may be shared with KTTWT and travel suppliers as needed to complete your bookings. Your data is handled in accordance with KTTWT’s privacy policy and applicable regulations.
12. Governing Law
These Terms are governed by the laws of the State of Washington. Any disputes related to planning or consulting services provided by Jess Peterman LLC will be handled in courts located in Spokane County, Washington after an attempt at mediation.
Disputes involving travel bookings themselves fall under KTTWT’s Terms & Conditions.
13.No Guarantee of Outcomes
Recommendations, opinions, and travel advice are based on professional judgment, experience, and information available at the time of planning. Jess Peterman LLC does not guarantee specific outcomes, supplier performance, availability, pricing stability, weather conditions, travel requirements, safety conditions, or satisfaction with any service provided by third-party suppliers. Decisions made by the Client based on the information provided are the Client’s responsibility, and Jess Peterman LLC is not liable for any losses, changes, dissatisfaction, or consequences resulting from those decisions.
14. Acknowledgment
By approving a proposal, signing an invoice or authorizing payment, you confirm that you have read and agree to both these Terms and KTTWT’s Terms of Service, and that you are authorized to accept on behalf of all travelers in your party.
