Client agreement

Terms & Conditions

Please review these terms before approving a proposal, authorizing a payment or confirming travel arrangements.

Effective October 1, 2026 Version 2026.10.01-R17 WA SOT No. 605974948

Jess Peterman LLC, doing business as Jess Peterman Travel (“Advisor,” “we,” or “I”), provides professional travel planning and consulting services as an independent affiliate of WorldVia Travel Network (“WorldVia”). Jess Peterman LLC is registered as a Washington Seller of Travel, Registration No. 605974948. Travel reservations may be processed through WorldVia and the applicable travel suppliers under their respective credentials and terms.

The person who affirmatively accepts these Terms as the primary or lead traveler is the “Lead Traveler.” Each person listed in the applicable planning engagement or reservation is a “Traveler.” “Client” means the Lead Traveler and, where the Lead Traveler has authority to bind another Traveler, that Traveler for purposes of these Terms.

By signing, checking a required acceptance box or otherwise completing Advisor’s affirmative electronic acceptance process, Lead Traveler accepts these Terms for themselves and, as authorized agent, for every Traveler whom Lead Traveler is authorized to bind. Lead Traveler represents and warrants that each adult Traveler has expressly authorized Lead Traveler to bind that Traveler with respect to the travel arrangements, these Terms—including the Professional Planning Retainer in Section 2, the Liability Limitations in Section 9 and the binding arbitration provision in Section 13—and applicable supplier terms provided or linked before the applicable booking or payment authorization. Lead Traveler also represents that they have the necessary parent or guardian authority for each minor Traveler. Advisor may reasonably rely on this warranty of authority unless Advisor has actual notice that the authority has been revoked or does not exist. Lead Traveler must provide reasonable confirmation of authority if Advisor requests it and is responsible for sharing confirmations, notices, requirements and travel documents with the other Travelers.

Planning and booking

How we work together

1

Scope of Services

Advisor provides professional travel planning and consulting services as an independent affiliate of WorldVia. Jess Peterman LLC maintains its own Washington Seller of Travel registration. Travel reservations may be processed through WorldVia, directly with the applicable travel supplier or through another disclosed booking or payment system. Professional planning fees paid directly to Advisor are compensation for Advisor’s services and are addressed separately below.

Advisor acts as an agent for disclosed third-party travel suppliers, including airlines, cruise lines, hotels, tour operators, transportation providers and destination management companies. Advisor does not own, operate, manage or control those suppliers. Advisor will perform its own professional planning and reservation-facilitation duties reasonably and with ordinary care. Supplier services remain subject to each supplier’s terms, decisions and performance.

Advisor provides itinerary design, travel planning, supplier coordination and reservation facilitation based on information provided by Client. Advisor does not guarantee pricing, availability, schedules, amenities, supplier performance, weather, entry approval, travel outcomes or satisfaction with third-party services. Pricing and availability are subject to change until the applicable supplier accepts the required deposit or payment and confirms the reservation. Advisor does not provide legal, medical, financial, immigration or real-time travel monitoring services unless expressly agreed in writing.

2

Professional Planning Retainer

Professional travel planning services are compensated through a professional planning retainer generally beginning at $300 per person for trips up to two weeks. The final amount is disclosed before payment and is based on trip complexity, duration, number of travelers and requested planning scope.

The retainer compensates Advisor for accepting the planning engagement, reserving professional capacity for Client and performing pre-booking professional services, which may include consultation, review of Client preferences and requirements, destination and supplier research, availability and pricing research, comparison of options, proposals and quotes, itinerary strategy and design, and administrative preparation. The planning scope is only the scope expressly identified by Advisor in the planning-fee proposal, invoice or other written engagement description provided before payment.

Client questionnaires, intake forms, emails, messages, wish lists and preference information help Advisor understand Client’s goals but do not independently expand the planning scope or create guaranteed deliverables. Unless Advisor expressly agrees otherwise in writing, the planning engagement does not guarantee a minimum number of destinations, resorts, hotels, cruises, suppliers, proposals, quotes, revisions or alternatives. Advisor determines the number and type of recommendations reasonably appropriate to the disclosed planning scope, Client preferences, availability and professional judgment.

Lead Traveler must affirmatively accept these Terms under Section 21 before the retainer is paid. Upon payment of the retainer after that acceptance, Advisor accepts the planning engagement, reserves professional capacity for Client and commits to perform the agreed planning services. The retainer is earned upon payment and is non-refundable to the fullest extent permitted by law. The timing of Advisor’s later research, proposal delivery, booking assistance or other work does not defer when the retainer is earned.

The retainer is not payment for a particular outcome or for Client’s subjective satisfaction with a proposal, quote, recommendation, destination, resort, hotel, cruise, supplier, itinerary or price. Client’s decision not to select, approve or book an option presented by Advisor does not mean the planning services were not provided and does not create a right to a refund.

Accordingly, except to the extent a refund is required by applicable law, the retainer will not be refunded because Client declines a proposal or quote, changes destinations or plans, chooses not to book, books independently or elsewhere, cancels the planning engagement, later cancels booked travel, or ultimately does not travel. If Advisor materially fails to perform the agreed planning services, any remedy is governed by applicable law and the enforceable limitations and dispute-resolution provisions of these Terms; dissatisfaction with recommendations or a decision not to book is not, by itself, a failure to perform.

Booking assistance, reservation management, supplier coordination or other support provided after the initial planning work does not convert the retainer into a payment for travel services or make it part of the vacation price. Additional service fees may apply for significant revisions, last-minute planning, reinstatement of canceled files, group coordination or post-booking changes when separately disclosed and approved.

3

Relationship with WorldVia Travel Network

Advisor is an independent affiliate of WorldVia. Depending on the reservation, WorldVia may serve as the host agency or agency of record and may provide booking, accreditation, payment-processing, support and administrative services. Advisor remains an independently owned business and is not an employee, partner, joint venturer or legal representative of WorldVia.

All reservations are also subject to the terms, conditions, privacy practices, payment rules and cancellation policies of the applicable travel suppliers. When supplier terms are provided or linked before booking or payment, Client agrees to review them before authorizing the transaction. If Client authorizes Advisor to proceed after those terms are provided or linked, Client acknowledges and accepts the applicable supplier terms to the extent permitted by law. WorldVia’s privacy policy is available at: worldviatravelnetwork.com/privacy-policy

4

Role of the Travel Advisor

In arranging travel, Advisor acts as an agent for the travel suppliers providing the travel services. Advisor does not own, operate or control those suppliers. Suppliers make decisions regarding schedules, delays, cancellations, substitutions, service delivery, credits and refunds. Advisor may assist with communication and reasonable advocacy but cannot compel a supplier to approve a request or provide a particular remedy.

Advisor remains responsible for its own acts and omissions to the extent required by applicable law, subject to the enforceable limitations, exclusions and liability cap set forth in these Terms, including Section 9. Nothing in these Terms eliminates a duty, remedy or consumer right that applicable law does not permit the parties to waive or limit.

5

Client Responsibilities

Client agrees to provide complete and accurate information, including traveler names exactly as shown on the identification that will be used for travel, dates of birth, contact information, citizenship, residency and any special requirements relevant to the requested arrangements. Client is responsible for reviewing passport validity, visa and transit requirements, vaccination or health requirements, entry rules, criminal-history restrictions and documentation requirements for every destination and transit point. Government approval, visa issuance and admission into a destination are never guaranteed.

If Client requests an accommodation or asks Advisor to consider a mobility, accessibility, dietary, health or similar need when selecting or arranging travel, Client should provide the information reasonably necessary for Advisor to evaluate and communicate that request to applicable suppliers. Advisor will communicate disclosed requests as reasonably necessary but cannot guarantee that a supplier will accommodate them. Collection, use and disclosure of consumer health data remain subject to Section 11, the Consumer Health Data Privacy Policy and any separate notice, authorization or consent required by applicable law.

Client is responsible for carefully reviewing all proposals, invoices, confirmations, tickets and travel documents, including traveler names and spellings, dates of birth where shown, travel dates, destinations, flight details, airports, accommodations, room or cabin categories and other reservation details. Client must notify Advisor immediately, and in all events within twenty-four (24) hours of receipt, of any error or discrepancy. Client is responsible for additional costs or supplier penalties resulting from Client’s failure to timely identify an error that was reasonably apparent from the documents provided, except to the extent caused by Advisor’s failure to exercise legally required care.

6

Payments & Payment Authorization

Payments for travel services may be charged directly by suppliers, processed through WorldVia’s approved systems or processed through another disclosed booking or payment system. Client authorizes Advisor, WorldVia and disclosed payment processors to process or transmit payment information only for the specific charge, booking or payment schedule approved by Client in the applicable payment authorization. A prior payment authorization does not authorize unrelated or additional charges.

Professional planning fees and other fees identified as compensation to Advisor are separate from funds paid for supplier travel services. Jess Peterman LLC is registered as a Washington Seller of Travel under Registration No. 605974948 and maintains a surety bond as permitted by Washington law. Advisor will maintain payment and transaction records as required by applicable law.

When applicable supplier cancellation, change or refund terms are provided or linked with a booking or payment authorization, Client agrees to review those terms before authorizing the transaction. By authorizing the specific charge or scheduled payment after those terms are provided or linked, Client acknowledges and accepts the applicable supplier terms to the extent permitted by law.

Client agrees not to initiate or pursue a chargeback or payment reversal for a charge that Client authorized and that was properly processed in accordance with the applicable booking, supplier terms and these Terms, except where Client has a good-faith basis to dispute the charge under applicable law, the cardholder agreement or card-network rules. Client agrees to contact Advisor promptly regarding any billing concern and, when practicable, provide a reasonable opportunity to investigate and assist before initiating a payment dispute. If Client knowingly submits a false or bad-faith payment dispute after authorizing a transaction, Advisor may pursue remedies and documented costs permitted by applicable law. A payment dispute or chargeback does not by itself cancel a reservation, alter otherwise applicable supplier cancellation terms, or extinguish Client’s obligation for professional fees validly earned under these Terms, subject to applicable law and card-network rules.

Nothing in Section 13 prevents Client from exercising a good-faith cardholder or card-network dispute right preserved by this Section 6. A chargeback or card-network process is separate from the contractual dispute-resolution procedure between Client and Jess Peterman LLC. Participation in, or the outcome of, a chargeback or card-network process does not by itself waive, adjudicate or finally resolve either party’s underlying contractual claims, defenses or remedies except to the extent required by applicable law, card-network rules or an express written settlement between the parties. Any remaining contractual dispute between Client and Jess Peterman LLC remains subject to Section 13 to the extent permitted by law.

Changes and protection

Cancellations, Washington notice and insurance

7

Changes and Cancellations

All bookings are subject to supplier change and cancellation policies. Supplier rules govern penalties, credits and refund timelines. The Professional Planning Retainer is governed by Section 2 and remains separate from supplier travel charges, deposits, cancellation penalties, credits and refunds. Client acknowledges that supplier cancellation penalties may begin immediately after deposit and may increase as travel approaches.

Advisor will disclose known cancellation and change penalties through the proposal, invoice, payment authorization or supplier terms provided or linked before the applicable booking or payment authorization. Client is responsible for reviewing those terms before authorizing the transaction.

Advisor will use reasonable efforts to transmit an authorized change or cancellation request promptly. The effective date and time of a supplier change or cancellation, and any resulting penalty, credit or refund, are determined by the applicable supplier’s terms and processing rules. Advisor does not control the supplier’s processing or acknowledgment time.

7A

Washington Seller of Travel Notice

Jess Peterman LLC, doing business as Jess Peterman Travel, is registered as a Washington Seller of Travel, Registration No. 605974948.

Cancellation and change penalties apply to these arrangements. Details will be provided upon request.

If transportation or other services are canceled by the seller of travel, all sums paid to the seller of travel for services not performed in accordance with the contract between the seller of travel and the purchaser will be refunded within thirty days of receiving the funds from the vendor with whom the services were arranged, or if the funds were not sent to the vendor, the funds shall be returned within fourteen days after cancellation by the seller of travel to the purchaser unless the purchaser requests the seller of travel to apply the money to another travel product and/or date.

8

Travel Protection Insurance

Travel protection insurance is strongly recommended. Coverage, exclusions, benefit limits, eligibility requirements and claim decisions are governed solely by the issued policy. Marketing descriptions, quotes and summaries do not replace the policy. The insurance company or plan administrator, not Advisor, determines coverage and claims.

Advisor does not guarantee that a policy will cover a particular event or that a claim will be paid. If Client declines coverage or does not purchase it within an applicable eligibility period, Client accepts the resulting financial risk. Advisor may require Client to document acceptance or declination of coverage separately.

Responsibility and risk

Important limits and traveler responsibilities

9

Liability Limitations & Aggregate Liability Cap

Advisor is not responsible for injury, loss, damage, delay, inconvenience or irregularity caused by the acts or omissions of independent travel suppliers or by events beyond Advisor’s reasonable control, including schedule changes, cancellations, weather events, labor disputes, government actions, epidemics, civil unrest and force majeure events.

To the maximum extent permitted by law, and except for liability arising from Advisor’s fraud, willful misconduct, gross negligence, or another liability or remedy that applicable law does not permit the parties to exclude or limit, Advisor is not liable for indirect, incidental, consequential, special, emotional-distress, loss-of-enjoyment or punitive damages arising out of or relating to independent supplier acts or omissions, events beyond Advisor’s reasonable control, or Advisor’s professional travel planning, consulting, booking facilitation, reservation support, payment authorization or related services.

These limitations do not limit obligations of independent travel suppliers, reduce any statutory refund obligation or pass-through client funds that Advisor is legally required to return, or eliminate any duty, remedy or consumer right that applicable law does not permit the parties to waive or limit.

10

Pricing Accuracy Disclaimer

Jess Peterman Travel makes reasonable efforts to provide accurate pricing at the time of a quote or proposal. Travel pricing is dynamic and may change without notice, including airfare, accommodations, cruise fares, taxes, fees, fuel surcharges and exchange rates.

If an incorrect price is quoted because of a clerical error, system error or supplier-provided inaccuracy, Advisor may correct the pricing before confirmation. Client will be notified as soon as reasonably possible and may accept the corrected price or decline the unconfirmed booking without an Advisor-imposed penalty.

No reservation or price is confirmed until the applicable supplier accepts the required deposit or payment and issues confirmation. Supplier-imposed penalties may apply after confirmation.

11

Use of Personal Data

Personal information provided by Client is used to create, manage and secure travel arrangements. Client authorizes Advisor to share information with WorldVia, travel suppliers, insurance providers, payment processors, technology and software providers and other service providers as reasonably necessary to provide the requested services. Client data is handled in accordance with applicable privacy policies and law.

11A

Technology-Assisted Services & AI

Advisor may use software, automation and artificial-intelligence-assisted tools to support research, organization, drafting, comparison and administrative functions. These tools support, but do not replace, Advisor’s professional judgment. Automated or AI-assisted outputs may contain errors, omissions or outdated information, and Advisor will use reasonable care in reviewing material information used to provide planning services.

Any personal information processed through third-party technology providers remains subject to the applicable privacy policies, contractual safeguards and law.

11B

Advisor Materials & Personal Use

To the extent permitted by law, original itineraries, recommendations, guides, research summaries, planning documents, written materials, graphics and other original materials created by Advisor remain the intellectual property of Jess Peterman LLC unless expressly stated otherwise. Client receives a limited, non-exclusive license to use those materials for Client’s personal travel purposes and may share them with the travelers and service providers involved in the applicable trip.

Client may not sell, republish, commercially distribute, reproduce for unrelated travelers, use to provide competing travel-planning services or otherwise commercially exploit Advisor’s original materials without prior written permission. Third-party photographs, maps, supplier materials, trademarks and other third-party content remain the property of their respective owners and are subject to their own terms.

12

Governing Law

These Terms are governed by the laws of the State of Washington without depriving Client of any nonwaivable consumer protection available under applicable law.

13

Dispute Resolution & Binding Arbitration

Informal resolution first. Before initiating arbitration or any permitted court proceeding, the party asserting a dispute must provide written notice describing the dispute and requested relief. Notice to Advisor must be sent to jess@jesspeterman.com and to Jess Peterman LLC, 14809 E 10th Ave, Veradale, WA 99037. Notice to Client may be sent to the Lead Traveler’s last email or mailing address provided to Advisor. The parties will then have thirty (30) days to attempt in good faith to resolve the matter informally. This waiting period does not apply when filing is reasonably necessary to preserve a claim or legal right, comply with a statute of limitations or other filing deadline, or seek temporary or emergency injunctive or provisional relief.

The agreement to arbitrate is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16, because the services and travel transactions contemplated by these Terms may involve interstate or international commerce. To the extent the Federal Arbitration Act does not govern or does not preempt state law, Washington’s Uniform Arbitration Act, chapter 7.04A RCW, applies.

The arbitration will be heard by one neutral arbitrator. The parties will attempt to agree on the arbitrator within fifteen (15) days after a written demand for arbitration. If they cannot agree, either party may ask a court of competent jurisdiction in Spokane County, Washington to appoint a neutral arbitrator as permitted by applicable arbitration law, including RCW 7.04A.110 when applicable. The arbitrator may establish reasonable procedures consistent with applicable arbitration law and the terms of this agreement. The arbitration may be conducted remotely unless the parties agree otherwise or the arbitrator determines that an in-person hearing is reasonably necessary. Any in-person arbitration will take place in Spokane County, Washington unless applicable law requires otherwise.

Client’s required share of arbitrator and forum fees will not exceed the filing fee Client would be required to pay to commence a comparable claim in a Washington state court. Advisor will pay the remaining arbitrator and forum fees, except to the extent applicable law permits a different allocation and the arbitrator, after considering the merits and applicable law, orders reallocation based on a frivolous claim, bad-faith conduct or another legally sufficient basis. Each party is otherwise responsible for its own attorneys’ fees and costs except where applicable law or another enforceable provision of the parties’ agreement authorizes an award of fees or costs.

The arbitrator may award any remedy or relief permitted by applicable law, subject to any enforceable limitation of liability or remedy limitation contained in these Terms; provided, however, that no contractual limitation will restrict a right or remedy that applicable law does not permit the parties to waive or limit.

Limited court proceedings. An arbitration award is final and binding to the fullest extent permitted by law. Court proceedings concerning a covered dispute are limited to matters permitted by applicable law, including compelling or staying arbitration, obtaining temporary or emergency provisional relief, appointing an arbitrator when necessary, and confirming, correcting, modifying, vacating or enforcing an arbitration award. A claim that is not legally subject to arbitration may be brought, after satisfaction of the informal-resolution requirement above when applicable, in a state court located in Spokane County, Washington or, when federal jurisdiction exists, in the United States District Court for the Eastern District of Washington. Client and Advisor consent to personal jurisdiction in those courts to the extent permitted by law.

This section does not alter a separate dispute-resolution provision that governs WorldVia or a travel supplier and does not waive any right, remedy, statutory claim, consumer protection or procedural safeguard that cannot legally be waived or restricted.

Arbitration severability. If a provision of this Section 13 is found invalid or unenforceable, that provision will be severed or limited to the minimum extent necessary and the remaining arbitration provisions will remain in effect, including the parties’ agreement to resolve covered disputes by binding arbitration, unless applicable law requires the arbitration agreement as a whole to be unenforceable.

14

No Guarantee of Outcomes

Recommendations and travel advice are based on professional judgment and information available at the time. Advisor does not guarantee supplier performance, availability, pricing stability, weather, government requirements, safety conditions, entry approval or satisfaction with third-party services. Advisor will use reasonable care in providing its own services but cannot guarantee a particular travel outcome.

15

Assumption of Travel Risk

Client understands that travel involves risks including illness, injury, crime, political instability, transportation delays, mechanical failures, weather events, supplier insolvency, governmental actions and civil unrest. Client accepts the ordinary and inherent risks of travel and participation in selected activities or excursions.

Nothing in these Terms is intended to release, waive or limit a minor Traveler’s personal-injury claim or other right to the extent applicable law does not permit a parent, guardian or Lead Traveler to release, waive or limit that right in advance.

16

Third-Party Excursions

Excursions or activities not operated directly by a primary supplier are independent services. Participation may involve physical exertion and risk of injury or death. Advisor does not control provider operations, staffing, equipment, vehicles or safety protocols. Client is responsible for deciding whether an activity is appropriate based on the provider’s information, Client’s abilities and Client’s medical circumstances.

17

Indemnification

To the extent permitted by law, Client agrees to indemnify and hold harmless Jess Peterman LLC from third-party claims, losses and reasonable costs arising directly from Client’s intentional misconduct, unlawful conduct, material breach of these Terms, or knowingly false or materially incomplete information provided for a reservation. If Lead Traveler represents that they have authority to bind another traveler but lacks that authority, Lead Traveler is responsible, to the extent permitted by law, for reasonable documented losses and costs incurred by Advisor as a direct result of that breach of the warranty of authority.

18

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

19

Force Majeure

Advisor is not responsible for a failure, delay, disruption, cancellation, refund limitation, credit issuance, supplier refusal to refund or modification of travel services caused by events beyond Advisor’s reasonable control. These events may include natural disasters, pandemics, public health emergencies, government restrictions, border closures, supplier insolvency, labor strikes, severe weather, civil unrest, terrorism and mechanical failures.

The Professional Planning Retainer remains governed by Section 2 and is not converted into a supplier payment, vacation deposit or travel-service charge because of a force majeure event.

Agreement and acceptance

How these terms become part of your reservation

20

Entire Agreement and Supplier Terms

These Client Terms govern Advisor’s professional travel planning, consulting, booking facilitation, reservation support, payment authorization and related client services. They operate together with the applicable proposal, invoice, payment authorization and other transaction-specific documents provided for the applicable reservation.

Advisor’s Website Terms of Use separately govern access to and use of Advisor’s website. Advisor’s Privacy Policy and Consumer Health Data Privacy Policy govern the collection, use, disclosure and handling of personal information and consumer health data. Those website and privacy documents do not replace these Client Terms.

Applicable travel-supplier terms govern the supplier’s travel services, including the supplier’s payment, change, cancellation, refund and operational rules. Any insurance policy governs the insurance coverage issued under that policy. Any WorldVia terms provided with a booking or payment authorization govern WorldVia’s own role, services and obligations according to their scope; they do not modify Jess Peterman LLC’s professional-fee, liability, arbitration or other obligations under these Client Terms unless the WorldVia document expressly identifies the provision being modified, expressly states that it modifies that provision as to Jess Peterman LLC, and Client accepts that modification.

These Terms supersede prior discussions or marketing statements concerning Advisor’s professional client services. The supersession of prior versions of Jess Peterman Travel’s general Client Terms & Conditions is addressed in Section 23 below.

21

Electronic Acceptance

These Terms become binding when Lead Traveler signs, checks the required acceptance box or otherwise completes Advisor’s affirmative electronic acceptance process. Payment alone, without the required acceptance step, is not intended to substitute for affirmative acceptance of these Terms.

By accepting these Terms, Lead Traveler confirms that Lead Traveler has read and accepts them for themselves and, as authorized agent, for every Traveler whom Lead Traveler is authorized to bind. Lead Traveler represents and warrants that each adult Traveler has expressly authorized Lead Traveler to bind that Traveler with respect to the travel arrangements, these Terms—including Section 2 (Professional Planning Retainer), Section 9 (Liability Limitations & Aggregate Liability Cap) and Section 13 (Dispute Resolution & Binding Arbitration)—and applicable supplier terms provided or linked before the applicable booking or payment authorization. Lead Traveler also represents that they have the necessary parent or guardian authority for each minor Traveler. Advisor may reasonably rely on this warranty of authority unless Advisor has actual notice that the authority has been revoked or does not exist and may require reasonable confirmation of authority before processing a further payment, material change or cancellation request.

Lead Traveler’s acceptance applies to the Travelers identified in the applicable planning engagement or reservation at the time of acceptance. Advisor may retain or associate with the acceptance record the Traveler list, recorded date and time, applicable Terms version and other evidence of assent to the extent permitted by law.

22

No Waiver & Survival

Advisor’s failure or delay in exercising or enforcing any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver is effective only for the specific circumstance for which it is given and does not constitute a continuing waiver unless expressly stated in writing.

Provisions that by their nature are intended to continue after completion, cancellation or termination of the planning engagement or travel arrangements—including provisions concerning earned professional fees, payment obligations, intellectual property, indemnification, limitations of liability, dispute resolution, governing law and applicable rights and remedies—survive to the extent permitted by law.

23

Terms Version and Supersession

This version supersedes and replaces all prior versions of Jess Peterman Travel’s general Client Terms & Conditions for future use as of the Effective Date. All new planning engagements, reservations and payment authorizations presented with this version after the Effective Date are governed by this version when Lead Traveler affirmatively accepts these Terms as provided in Section 21.

For a reservation or planning engagement that was already formed under an earlier version, this version replaces the earlier general Client Terms & Conditions only when Lead Traveler affirmatively accepts this version in accordance with Section 21. When Lead Traveler affirmatively accepts this version in connection with an existing reservation, including in connection with a payment authorization or material booking change, this version supersedes the prior general Client Terms & Conditions for that reservation from the date of acceptance forward. For an existing reservation moved to this version, the binding arbitration provision in Section 13 applies to disputes based on acts, omissions or events occurring on or after Lead Traveler’s acceptance of this version, unless the affected parties separately agree otherwise after a dispute arises or applicable law requires a different result. Nothing in this section is intended to impose a material modification on an existing agreement without the assent required by applicable law.

Advisor may update these Terms for future services and transactions. Client should save or print the version provided for the applicable reservation. Advisor will retain reasonable records of the applicable terms and electronic acceptance consistent with its recordkeeping practices and applicable law.
