TERMS AND CONDITIONS

These Terms and Conditions constitute a binding agreement between Jess Peterman LLC d/b/a Jess Peterman Travel and the Traveler. By submitting your booking form and deposit, you confirm that you have read, understood, and agree to all terms below. If you do not agree, do not submit payment.

1. Parties and Intermediary Role

1.1 This agreement is between Jess Peterman LLC d/b/a Jess Peterman Travel (“The Advisor”) and the individual traveler submitting a booking (“The Traveler”).

1.2 Jess Peterman Travel is a WV Travel Network independent agency. The Advisor acts as an intermediary between the Traveler and independent third-party suppliers including HeavenWood Travel (DMC), The Rebello Porto, Hotel Pessoa Lisboa and all excursion, activity and transportation operators.

1.3 Each third-party supplier provides its services under its own terms and remains responsible for its acts, omissions, operations and service delivery. The Advisor is not responsible for the acts, omissions, delays or defaults of an independent third-party supplier. Nothing in this agreement limits responsibility that applicable law places directly on The Advisor for its own acts or omissions.

1.4 The Advisor will provide applicable supplier terms, cancellation policies and booking disclosures before or at the time payment is requested. By submitting payment, the Traveler acknowledges receipt of and agreement to those terms.

2. Communication and Contact Information

Any concerns, requests, or questions regarding your travel package must be submitted in writing to Jess Peterman Travel:

Reservations are not confirmed until independently confirmed by The Advisor in writing. Emergency contact details including a local operations contact in Portugal will be provided to all travelers prior to departure.

3. Payment Terms

3.1 Pricing

  • Double Occupancy: $7,750 per person
  • Single Supplement: +$2,000 per person (sole use of a double room)

All prices are in U.S. dollars. Prices are subject to change until deposit is received. Once your deposit is processed, your price is locked.

3.2 Payment Schedule

  • Reservation Deposit: $1,200 per person, due at booking. Non-refundable. Reserves your place in the group subject to the minimum participant requirement in Section 7.5.
  • First Payment: $3,275 due by December 15, 2026.
  • Final Payment: $3,275 due by May 14, 2027.

Reservations are not confirmed until the deposit is received and The Advisor confirms the reservation in writing. Spaces are held on a first-come, first-served basis. The trip is not guaranteed to operate until The Advisor confirms that the minimum participant requirement has been met or waived.

3.3 Late Payments

Failure to submit payment by the designated due date may result in cancellation of your reservation without prior notice. In that case, the cancellation policy below applies.

3.4 Change Fees

Changes to reservations including travel dates, room type, or package components are subject to availability and supplier approval. Changes requested less than 90 days before departure may be subject to change fees assessed by third-party suppliers. The Traveler is responsible for any increase in price resulting from a change. The Advisor cannot guarantee changes will be accommodated.

4. Cancellation, Refund and Transfer Policy

4.1 Non-Refundable Payments

Except when a refund is required by applicable law or when The Advisor cancels the trip as described below, every payment made by or on behalf of a Traveler is non-refundable once received. This includes the reservation deposit, installment payments, final payment and payments made under an alternate written payment plan.

The Traveler acknowledges that this hosted trip has limited capacity and group pricing and that The Advisor and third-party suppliers make advance financial and operational commitments based on confirmed enrollment. A cancellation may also leave a space that The Advisor cannot reasonably resell. Required travel insurance is intended to give the Traveler a possible source of reimbursement for covered losses subject to the policy terms and claim decision of the insurance provider.

4.2 Written Traveler Cancellation

All cancellations must be submitted in writing to jess@jesspeterman.com. A cancellation becomes effective when The Advisor receives it. The Advisor will confirm receipt in writing. The non-refundable policy applies regardless of the Traveler’s reason for cancellation including illness, injury, personal circumstances, fear of travel, financial hardship, changes in government advisories or a decision not to travel.

4.3 Missed Payments, No-Shows and Unused Services

Failure to make a required payment by the stated deadline may result in cancellation and the non-refundable policy will apply. No refund, credit or future travel credit will be issued for a no-show, late arrival, early departure or a decision not to participate in an included accommodation, transfer, meal, tour, activity or other service.

4.4 Roommate Cancellation

If one Traveler in a shared room cancels and no approved replacement is found, the remaining Traveler is responsible for the resulting single supplement or room-occupancy adjustment. An individual cancellation will not increase the general package price for unrelated travelers.

4.5 Transfer to a Replacement Traveler

A Traveler may request a transfer of the land reservation to a replacement Traveler up to 90 days before departure. Every transfer requires written approval from The Advisor and all affected suppliers. The replacement Traveler must meet all eligibility requirements, sign the required agreements, provide required documents, obtain required travel insurance and pay all amounts due. A $250 administrative fee and all supplier change fees apply. The original Traveler remains responsible for the reservation until The Advisor confirms the completed transfer in writing. No transfer is permitted within 90 days of departure. International airfare is not included and the Travelers remain responsible for all flight changes and costs.

4.6 Minimum Enrollment Cancellation

The trip requires at least eight paid and confirmed adult Travelers by December 8, 2026 unless The Advisor elects in writing to operate with fewer participants. If The Advisor cancels the trip because the minimum is not met, The Advisor will refund all sums paid directly to The Advisor for services not performed. Funds that were not sent to a supplier will be returned within 14 days after cancellation. Amounts returned by a supplier will be refunded within 30 days after The Advisor receives those funds. At the Traveler’s written request, refundable funds may instead be applied to another travel product or date.

4.7 Cancellation or Nonperformance by The Advisor or a Supplier

Nothing in this agreement limits refund rights that cannot lawfully be waived. If The Advisor cancels transportation or other contracted services or if money is otherwise due to be refunded, The Advisor will process refunds as required by applicable law and the governing supplier agreements. The Advisor is not required to refund a supplier cancellation penalty imposed after a Traveler cancellation when that penalty was properly disclosed as required by law.

4.8 External Arrangements

The Advisor is not responsible for non-refundable airfare, accommodations or other arrangements purchased outside this package. Travelers should not purchase non-refundable external arrangements until The Advisor confirms in writing that the trip will operate.

5. What Is Included

  • 11 nights hotel accommodation (double occupancy) at The Rebello, Porto (5 nights) and Hotel Pessoa Lisboa (6 nights), or similar
  • Daily breakfast and city tax at both hotels
  • Private airport transfers on arrival and departure
  • All private group transfers throughout the program
  • Welcome reception with light bites and drinks on arrival evening
  • Bottled water and a light snack per traveler on the three long days (Douro Valley, Porto-to-Lisbon transfer and Sintra)
  • All tours, local guides and experiences as outlined in the itinerary
  • Gratuities for all included activities, guides, drivers and hotel staff
  • VAT included

All tours and experiences are private to the group.

6. What Is Not Included

  • International flights to and from Portugal
  • Travel insurance (required)
  • Lunches and dinners not specified in the itinerary
  • Personal expenses
  • Optional add-on tours: Aveiro and Costa Nova day trip and Alentejo full-day trip (pricing provided separately). Optional tours must be confirmed and paid for no later than 90 days before departure, subject to availability and minimum participant requirements.

7. Participant Eligibility and Requirements

7.1 Age Requirement. All participants must be at least 18 years old at the time of travel.

7.2 Physical Fitness. This trip includes walking on cobblestone streets, hills, stairs, and uneven terrain. Several days involve full-day excursions with extended periods of walking and standing. Participants should be in good general health and physically capable of walking moderate distances on uneven surfaces. Participants are responsible for accurately representing their physical fitness and health conditions at booking. Travelers with mobility limitations or accessibility needs should contact The Advisor prior to booking to discuss the physical requirements of the itinerary.

7.3 Conduct. This is a curated group experience. Participants are expected to treat fellow travelers, guides, local staff, and communities with respect at all times. The following behaviors will result in immediate removal from the trip without refund:

  • Discrimination, harassment, or bullying of any kind, including on the basis of sex, sexual orientation, gender identity, race, color, religion, national origin, age, or disability
  • Threatening, violent, or disorderly behavior
  • Behavior that materially disrupts the experience of other travelers, guides, or staff
  • Violation of local laws

The Advisor maintains a zero-tolerance policy for the above. Travelers who are removed from the trip for conduct reasons waive any right to a refund for payments made.

7.4 Right to Refuse. The Advisor reserves the right to refuse or remove any participant whose conduct, health condition, or behavior may negatively impact the safety or experience of the group. No refund will be issued in such cases.

7.5 Minimum Participant Requirement and Trip Viability. This group trip requires a minimum of eight (8) paid and confirmed adult Travelers to operate as planned.

Go or No-Go Date: The minimum enrollment cutoff is December 8, 2026. The trip is not guaranteed to operate until The Advisor confirms in writing that the minimum has been met or that The Advisor has elected to operate with fewer participants.

Cancellation if Minimum Is Not Met: If the minimum is not met by December 8, 2026 and The Advisor cancels the trip, refunds will be issued under Section 4.6.

Advisor Discretion: The Advisor may elect to operate with fewer than eight Travelers or may offer confirmed Travelers a written choice of modified pricing or itinerary terms. No modification becomes effective unless the Traveler accepts it in writing.

External Arrangements: The Advisor is not responsible for non-refundable international airfare or other external arrangements purchased before the trip is declared guaranteed. Travelers should obtain the required travel insurance and should defer non-refundable airfare purchases until The Advisor confirms that the trip will operate.

8. Passport, Visa and Entry Requirements

8.1 All travelers must hold a valid passport with at least six months of validity beyond the return date of October 7, 2027. Passports must be valid through at least April 7, 2028.

8.2 U.S. citizens do not currently require a visa for Portugal for stays under 90 days. Entry requirements may change between booking and departure. The EU’s ETIAS (European Travel Information and Authorisation System) may be required for U.S. citizens by the time of travel. Travelers are solely responsible for monitoring and complying with all entry requirements.

8.3 The Advisor is not responsible for costs, losses, or disruptions arising from a traveler being denied boarding or entry due to passport, visa, ETIAS, or documentation issues.

8.4 Passport details must be submitted to The Advisor no later than April 1, 2027 to ensure accurate travel arrangements.

8.5 Traveler Information Accuracy. The Traveler is responsible for verifying that all personal information submitted for this trip is complete and accurate, including but not limited to: legal name (as it appears on the passport), date of birth, passport number, passport expiration date, and emergency contact details. The Advisor will provide traveler information for review before finalizing bookings. The Traveler must review and confirm accuracy promptly. The Advisor is not responsible for errors, delays, denied boarding, penalties, or additional costs resulting from incorrect or incomplete information provided by the Traveler.

8.6 Travelers are strongly encouraged to visit travel.state.gov for current entry requirements and travel advisories.

9. Required Travel Insurance

9.1 Travel insurance is required for every participant as a condition of travel. Each Traveler must purchase and maintain coverage for the full duration of the trip including departure and return travel days.

9.2 Required Coverage

  • Trip cancellation and interruption coverage equal to the Traveler’s total prepaid and non-refundable trip cost
  • Emergency medical coverage of at least $100,000 USD
  • Emergency evacuation and repatriation coverage

Cancel for Any Reason coverage is strongly recommended but is not required. It is available only under certain policies and purchase deadlines and it does not reimburse 100% of the insured trip cost.

9.3 Proof of Coverage

The Traveler must provide proof of qualifying coverage to The Advisor within 14 calendar days of paying the deposit. Proof should identify the insured Traveler, policy provider, policy number, coverage dates and benefit limits.

9.4 Insurance Information

The Advisor may provide general information, a quote or a link to coverage offered through a licensed insurance provider. The Advisor does not interpret policy language, determine coverage, evaluate the suitability of a policy or guarantee payment of any claim. The Traveler must review the full policy and direct coverage questions to the insurance provider.

9.5 Failure to Maintain Coverage

Failure to provide timely proof of qualifying coverage or failure to maintain the required coverage constitutes a material breach of this agreement. The Advisor may cancel the Traveler’s reservation and the cancellation policy in Section 4 will apply. The Traveler remains responsible for losses, expenses or claims that the insurance provider does not cover or pay.

10. Accommodations

10.1 Accommodations are at The Rebello, Porto (5 nights) and Hotel Pessoa Lisboa (6 nights), or similar. If either named hotel becomes unavailable, The Advisor will obtain a replacement that meets or exceeds the named hotel in location, room category, room standard, amenities, and overall guest experience.

10.2 Rooming configurations are confirmed at the time of booking based on availability. Specific room locations, floor preferences, and connecting room requests are on a request basis only and subject to availability at check-in.

10.3 Roommate Cancellation. If a Traveler’s roommate cancels and no replacement is found, the remaining Traveler will be responsible for the single supplement for the duration of the stay, or may cancel subject to the cancellation policy in Section 4.

10.4 Properties may require a valid credit card and government-issued photo ID at check-in to cover incidentals.

11. Flight Arrangements

11.1 International airfare is not included. Participants are responsible for independently booking flights to Porto (OPO) for arrival on September 26, 2027 and from Lisbon (LIS) for departure on October 7, 2027.

11.2 The Advisor can provide guidance on flight options upon request. Final responsibility for booking, confirming, and managing flights rests with the Traveler.

11.3 The Advisor is not responsible for costs or disruptions arising from flight delays, cancellations, or missed connections.

11.4 Baggage and personal effects are at all times the sole responsibility of the Traveler.

12. Itinerary and Service Changes

12.1 The Advisor will make every reasonable effort to operate the trip as described. The Advisor and its suppliers reserve the right to modify the itinerary, activities, accommodations, meals, or transportation as deemed necessary for safety, operational, or logistical reasons.

12.2 Excursions and activities are not guaranteed. They may be modified or cancelled due to weather, safety concerns, capacity, supplier changes, or circumstances outside The Advisor’s control.

12.3 Where a planned component cannot be delivered, The Advisor will use reasonable efforts to substitute a comparable alternative. No refund or compensation is guaranteed for operational changes outside The Advisor’s control.

13. Force Majeure

13.1 The Advisor is not liable for any loss, delay, cancellation, or disruption caused by circumstances beyond reasonable control, including but not limited to: natural disasters, extreme weather, pandemics, government restrictions, civil unrest, war, terrorism, strikes, or political instability.

13.2 If a force majeure event causes a cancellation or material service change, The Advisor will follow applicable law and the governing supplier agreements. The Advisor will use reasonable efforts to obtain available refunds or credits and will return any amounts legally due to the Traveler within the applicable refund timelines. The Advisor cannot guarantee that a supplier will offer a refund or credit beyond the supplier’s legal and contractual obligations.

13.3 Personal financial hardship does not qualify as a force majeure event.

14. Health and Medical

14.1 No vaccinations are currently required for U.S. citizens traveling to Portugal. Participants should consult their physician prior to travel for any recommended vaccinations or medications.

14.2 Participants with pre-existing medical conditions are responsible for disclosing these at the time of booking and consulting with their physician before travel.

14.3 The Advisor is not responsible for medical expenses, evacuation costs, or losses arising from illness, injury, or medical emergencies during the trip.

15. Photo and Video Release

15.1 By joining this trip, participants grant Jess Peterman and Jess Peterman Travel permission to use their image, likeness, and appearance in photographs and video recordings taken during the trip for promotional, educational, or commercial purposes on websites, social media, print materials, or other platforms.

15.2 Participants will not receive financial compensation for the use of these materials.

15.3 Travelers who do not wish to be photographed must inform The Advisor in writing prior to departure.

16. Liability and Hold Harmless

16.1 Assumption of Risk. Participants voluntarily assume all risks associated with this trip including international travel, walking on uneven terrain, and all included activities.

16.2 Liability Limitation. Jess Peterman and Jess Peterman Travel are not liable for injuries, accidents, illnesses, death, or property loss sustained during the trip.

16.3 Hold Harmless. The Traveler agrees to indemnify and hold harmless Jess Peterman Travel, its owner, contractors, and representatives from any and all claims arising out of their participation in the trip.

16.4 Third-Party Providers. The Advisor is not responsible for the acts or omissions of third-party service providers. Non-refundable supplier conditions will be communicated in advance.

17. Seller of Travel Disclosure

Jess Peterman LLC d/b/a Jess Peterman Travel is registered as a Seller of Travel in the State of Washington.

Registration as a seller of travel does not constitute approval by the State of Washington.

18. Refund Processing

When a cancellation results in a refund of eligible amounts, The Advisor will process the refund within thirty (30) days of receiving the recovered funds from the supplier, or within fourteen (14) days of cancellation if funds were not yet forwarded to the supplier. The Advisor is not obligated to refund any cancellation penalties imposed by the vendor if those penalties were disclosed in accordance with RCW 19.138.040.

19. Governing Law, Arbitration and Attorney Fees

19.1 Governing Law. This agreement shall be governed by the laws of the State of Washington.

19.2 Binding Arbitration.

Any dispute, claim, or controversy arising under or relating to this agreement shall, upon election by either party, be resolved by binding arbitration rather than in court. By agreeing to these terms, the Traveler waives the right to a jury trial and to participate in a class action.

Arbitration will be administered by the American Arbitration Association (AAA) in accordance with their Consumer Arbitration Rules. Proceedings will take place in the State of Washington unless otherwise agreed by both parties.

19.3 Attorney Fees. In the event of any legal action or arbitration to enforce this agreement, the prevailing party shall be entitled to recover reasonable attorney fees and costs.

20. General Conditions

20.1 Entire Agreement. This agreement constitutes the entire agreement between the parties and supersedes all prior representations, oral or written.

20.2 Modification. This agreement may not be modified except by written amendment signed by both parties.

20.3 Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
